Defensible IP

Why investors care

A Series A investor needs to know competitors can't copy you before they earn a return. Without that assurance, there is no investment case.

How we do it

We assess your IP for its business impact, not only its legal standing. Three questions guide the work:

  • How would a competitor design around it?
  • Is anything encumbering it — ownership gaps, prior licences or third-party rights?
  • How do we prevent future challenges?

We score your position on the IP Business Scorecard, which covers 20 business parameters, and share every score with you. We then build an IP strategy that makes your position defensible, and work with your patent counsel on filing.

Platform & Licensing

Why investors care

Investors reward focus, and they also reward upside. The strongest companies have both.

How we do it

We start with a question about identity.

Are you an ADC company that happens to work in one cancer — or a company that owns that cancer? Are you a computer-vision company, or a physiotherapy company that uses computer vision?

Clients tell us these conversations are liberating.

Winning requires a narrow focus, so we help you choose it. Then we make sure you're rewarded when your technology applies elsewhere, often in markets that seem unrelated. We identify those applications, build the partnerships, and structure field-of-use licences and carve-outs, so you earn from them while your team stays on its core goal.

Regulatory-to-Market

Why investors care

Approval is a milestone, not market leadership. Investors want to see both a credible, costed route to approval and a plan to win the market once you get there.

How we do it

On the regulatory side, we choose the most efficient pathway, including expedited designations and the order in which you enter jurisdictions. We plan the evidence you need now to keep that pathway open later. We deliver complete IND and equivalent packages, with CMC provided through our collaborators, and identify qualified trial sites across geographies that offer faster recruitment at lower cost.

On the market side, approval brings new audiences to win over: the standard of care you must beat, the competitors who will respond, and the prescribers and payers who decide adoption. We map each of them and build the strategy to win them.

Valuation & Deal Readiness

Why investors care

A valuation is only as strong as the assumptions beneath it, and investors test every one.

How we do it

Instead of handing you a single number that gets critiqued, we give you every assumption behind your valuation and a strategy to defend each one. We work through the questions investors will ask:

  • Is the valuation defensible?
  • What barriers protect the niche you are valuing?
  • Can you capture the full market you are promising?
  • What does this round buy, and does it reach a value-inflection milestone?
  • How will the deal be structured, including tranches, milestones, preferences and cross-border entities?

Why investors care

Will a product launched today still lead its market five and ten years from now? How many first-in-class products lose their lead to new entrants? Investors want a path to leadership that supports a profitable exit.

How we do it

Using AmethIntel, we analyse how market leaders hold their position and how new entrants take it away, through trial design, diagnostics, patent strategy, platform substitution and routes to first-line therapy. Then we apply that analysis to your product.
